Kivozara Terms of Use

1) Eligibility

The Service is intended for users who are at least 17 years old. By using the Service, you represent that you meet this requirement.

2) The Service

Kivozara is your personal style journal and inspiration archive. You can capture photos of accessory combinations, record memories, moods, and creative insights, and tag entries with dates for organization and timeline viewing.

We may add, remove, or modify features over time. Some features may require an internet connection.

3) Accounts

• Account information: you may need an account using name, username, and email.
• Security: you are responsible for maintaining confidentiality of credentials and all activity under your account.
• Accuracy: you agree to keep your account information accurate and up to date.

4) Your Content

4.1 Ownership

You retain ownership of the content you create, upload, or store through the Service (“User Content”).

4.2 License to Operate the Service

You grant Kivozara a limited license to host, store, reproduce, and process your User Content solely to provide, maintain, and improve the Service and to perform features you request (such as syncing/backup or optional server processing if provided).

4.3 Responsibility

You are responsible for your User Content and for ensuring you have the rights necessary to provide it. You agree not to upload content that violates the law or infringes others’ rights.

4.4 Optional One-Time Server Processing

If the Service offers optional one-time server-based generation/processing, you control whether to upload content and whether to generate output. When you choose to upload, your content may be transmitted to our servers to perform the requested operation. Such content is processed on our own servers, is not shared with third parties for that purpose, and is deleted immediately after processing completes.

5) Acceptable Use

You agree not to:

• Use the Service for any illegal, harmful, or abusive purpose.
• Attempt to gain unauthorized access to the Service or its systems.
• Interfere with or disrupt the Service (including introducing malware or excessive load).
• Reverse engineer or attempt to extract source code, except where prohibited by law.
• Use the Service to infringe intellectual property or privacy rights of others.

6) Intellectual Property

The Service (excluding User Content) is owned by Kivozara Team and its licensors. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

7) Third-Party Services

The Service may integrate with or rely on third-party services to operate (such as infrastructure or crash reporting). Third-party services are provided under their own terms and policies.

8) Fees

Unless otherwise stated, the Service is provided free of charge. If we introduce paid features, we will disclose pricing and applicable terms before you incur charges.

9) Termination

• By you: you may stop using the Service at any time. You may request account deletion by contacting us (or using any in-app method we provide).
• By us: we may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service and users.

10) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIVOZARA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIVOZARA TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL ARISING OUT OF OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIVOZARA TEAM’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM (OR, IF YOU PAID NOTHING, USD $10).

12) Indemnification

You agree to indemnify and hold harmless Kivozara Team from and against claims and expenses arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

13) Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and provide additional notice for material changes where required by law.

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction of Kivozara Team’s primary place of business (excluding conflict-of-law principles), unless applicable law provides otherwise.

Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration, except that either party may seek injunctive or equitable relief to protect intellectual property rights.

• Arbitration will be conducted in English.
• A single arbitrator will be appointed.
• The seat of arbitration will be the jurisdiction of Kivozara Team’s primary place of business.
• To the maximum extent permitted by law, disputes will be brought on an individual basis only (no class actions).
